Episode 2: Introducing the UK Modern Slavery Act 2015 series part 2. Section 45 - The Statutory Defence for Victims

Andrew Smith talks to Dr Alicia Kidd about Section 45 of the Modern Slavery Act 2015 (UK).

Potential victims of modern slavery may be suspected or accused of committing criminal offences. Section 45 of the Modern Slavery Act 2015 provides for a statutory defence for adult and child victims who have been forced, threatened, or deceived into committing certain crimes by their exploiters.

Alicia talks about:

  • The defence does not apply to the most serious crimes, such as sexual offences or offences involving serious violence.
  • No quantitative data is collected on Section 45 so it’s difficult to get an accurate idea of when it is being used.
  • There is still a lot of confusion around criminal exploitation with lots of examples of judges giving victims prison sentences while acknowledging that they were victims of MS
