#DPDPBSeries: Data Protection in India
Data Protection in India has been a work in progress since 2017, following the first landmark Puttaswamy Judgement where it was ruled that privacy is a fundamental right.Â
Five years later, after multiple deliberations and versions of the Data Protection Bill, the MeitY released Digital Personal Data Protection Bill, 2022 on November 18, 2022. While the latest iteration of the Bill has engaged with some of the significant issues around personal data, there are issues that have been excluded, particularly those focused on individual rights as opposed to business compliances.Â
As part of The Dialogueâs ongoing series - #DPDPBSeries, in this special episode, The Dialogueâs Founding Director Kazim Rizvi; Kamesh Shekar, Programme Manager (Privacy & Data Governance; and, Kriti Singh, Chief of Staff, come together to analyse and break down the Draft Digital Personal Data Protection Bill 2022.

Making Sense of the Blockchain Debate Today
In the crypto space, while regulations are still awaited in India and reports emerge of crypto exchanges relocating to foreign shores - the global situation does not offer much solace. Reports have indicated that the global market capitalisation for cryptocurrencies has shrunk from USD 3 trillion to USD 900 billion.Â
Alongside the valuation recalibration, deep-set governance issues are coming to light. As the ecosystemâs major âstable-coinsâ like Terra-Luna collapse and exchanges like Voyager are having to freeze transactions or close their shop a vast array of misgovernance and frauds are also rearing their heads affecting the credibility of many big players in the sector.Â
This breakdown of fiduciary norms has cast the viability of the game in deep doubt as large numbers of investors leave, jeopardizing the livelihoods of low-wage gamers in countries like Indonesia and the Philippines. In short, both public and regulatory scrutiny is at an all-time peak - if web3.0 has to flourish in any mass adoption pathway, winning back trust through viable and clear business models is a pressing need.
As The Dialogue's Sreyan Chatterjee introduces the main theme of this episode, Sagar Deoskar, former policy consultant at The Dialogue, talks to Akshay BD, former lawyer and tech enthusiast about the cryptocurrency space.
Special Episode: 5 Years of Right to Privacy | The Dialogue Room
Since 1954, the Supreme Court of India has tested in various cases whether the right to privacy should be a fundamental right. Through the K.S. Puttaswamy v. Union of India verdict, the Supreme Court recognized the right to privacy as a fundamental right under the Part III of the Constitution of India, in 2017, collectively addressing the concerns of the privacy cases that preceded it. This right is actually driven from Articles 14-18, 19 and 21, which relate to equality, freedom of expression and speech, freedom of movement, protection of life and personal liberty.Â
August 24, 2022 marked the fifth-year anniversary of the Right to Privacy judgement. In this special episode, Kamesh Shekar, Programmer Manager - Privacy and Data Governance, discussed the various aspects and concerns of privacy with his colleagues - Shruti Shreya (Programme Manager - Platform Regulation), Saksham Malik (Programme Manager - Competition Law) and Ayush Tripathi (Programme Manager - Emerging Technologies).Â

India's Data Governance Landscape with Eshani & Shefali (Aapti Institute)
The data economy, having given way to âdigital intelligenceâ, has formed a crucial part of our socio-political lives. With regulation having understood that the value of data is one that can lie not only in its technicality but also in its influence on human lives, data governance has been brought to the forefront of debates around GovTech. Our focus in this episode will be on data sharing in particular. Discussing themes around data sharing incentives, the various mechanisms of data sharing, trust in the form of stewardship and the governance of independent authorities, our goal is to grant the listener a birds-eye view of how the crucial transformation from physical to digital is taking place, or most importantly should take place.
