Susan Cappelletti had caregiver fatigue. She was working as a registered nurse AND serving as the primary caregiver for her mother, who lives with Susan in their Columbia County home.

Her mom has Parkinson's Disease and requires supervision to prevent a fall. How could Susan balance her career and her commitment to caring for her mom at home, not in a nursing home?? There simply weren't enough hours in the day. “Though I am a nurse, a caregiver, this was a challenge I had not expected,” she said. “To watch your family member progress in their disease and deterioration and to try to meet the needs as they change. That was eye-opening for me.”

In addition to explaining the difference in duties for an executor and trustee, here's a sneak peek at what we'll be discussing:

Skills You'll Need: the number one quality is time. A son or daughter with a PhD is not necessarily the best choice! The ideal executor or trustee is willing to devote extensive time and fortitude to take on the responsibility of estate administration. Not all estates are settled smoothly: there can be multiple cash and retirement accounts, businesses, properties. Plus challenges and litigation.

Attention to Detail: if the decedent did not prepare a list of assets, the hunt is on to marshal all accounts and appraise the values. Beneficiaries of the estate may also ask – or demand – to know about inheritance, which takes a cool head and meticulous record-keeping.

Tax Filings: There can be extensive financial work on an estate that may include hiring an accountant.

Commissions: the role of executor and trustee can be compensated, and in some cases it's a substantial amount. Your role will generate income, which is important to understand.

    Why? The study found that misconceptions about estate planning are the main cause of inaction.

But when the administration of an estate goes to Surrogate's court, it can veer into uncertain territory. As the probate of wills and the administration of estates take place, multiple parties are involved including a judge and potentially family members who disagree. How can you make sure you get what you are supposed to get?     A new study caught our eye this week with unsettling findings: the number of older Americans doing estate planning is... declining.

    The Center for Retirement Research at Boston College found that the share of people over age 70 who have wills and trusts in place dropped from 70% to 63%. Another study by Caring.com found Americans over age 55 completing a will between 2020 and 2023 declined to 46%.

    What's behind these trends? Listen as attorneys Frank Hemming and Kristen Peck will share the data and talk about the importance of getting your will, advance directives and other estate planning DONE.

    Procrastination isn't only a trend for older adults. Frank and Kristen will address the need for people with certain professions to plan.     When family disputes arise – whether it’s over a trust, an estate, or a guardianship matter – people are often tempted to record their interactions with the other party. They often believe that the audio or video clip will be helpful in their case. However, before you press that “record' button, you'll want to listen to this Life Happens Radio podcast.

    Our litigation team often speaks to clients who have filmed interactions, or audio-recorded phone calls, in an effort to prove that the “other side” is guilty. For instance, a sister records a conversation she shared with her brother because she believes he unlawfully changed their parent’s last will & testament. Or, perhaps a video is recorded of an elderly parent to later show the court that he/she lacked capacity or was being abused. 

    But as you'll hear from Pierro, Connor & Strauss litigation attorneys Aaron Connor and Jacob Verchereau, there are risks to consider when choosing to record. While you may think you are building a case, that is not always the case. Aaron and Jacob will explain how audio and video evidence can sometimes have an opposite effect.
