This Was A Challenge I Had Not Expected

Janice McNair, the principal owner of the team since 2018, is the subject of a guardianship petition by one of her sons. Robert Cary McNair, Jr is asking a probate court to declare his 87-year-old mother incapacitated and to appoint him as her guardian.

New Report: Over 50% Surveyed Haven't Done Any Estate Planning. Here's Why.

In a survey published this past fall, more than 1,000 participants aged 18 to 99 shared insights on their estate plans – or lack thereof. Surprisingly, more than half said they have not consulted an estate planner regarding a trust or will.
Why? The study found that misconceptions about estate planning are the main cause of inaction.

This Doesn't Add Up
Inheriting a loved one's assets can be a positive experience, by receiving cash, real estate, artwork, jewelry or other tangible items. But when the administration of an estate goes to Surrogate's court, it can veer into uncertain territory. As the probate of wills and the administration of estates take place, multiple parties are involved including a judge and potentially family members who disagree. How can you make sure you get what you are supposed to get? In this Life Happens Radio podcast, learn the steps you can take to ensure you get a fair share of what the decedent - i.e. deceased party- intended. Experienced litigation attorneys Aaron Connor and Jacob Verchereau describe how the probate process works in determining:

A new study caught our eye this week with unsettling findings: the number of older Americans doing estate planning is... declining.
The Center for Retirement Research at Boston College found that the share of people over age 70 who have wills and trusts in place dropped from 70% to 63%. Another study by Caring.com found Americans over age 55 completing a will between 2020 and 2023 declined to 46%.
What's behind these trends? Listen as attorneys Frank Hemming and Kristen Peck will share the data and talk about the importance of getting your will, advance directives and other estate planning DONE.
Procrastination isn't only a trend for older adults. Frank and Kristen will address the need for people with certain professions to plan. For instance, mediation involves a neutral third-party mediator who helps the parties reach a mutually beneficial agreement. Arbitration is similar to mediation, but the arbitrator makes a final decision that is binding on the parties. Neither involves the courtroom, where a judge makes a final decision.

To Record or Not To Record: Audio and Video Evidence in Estate Litigation

When family disputes arise – whether it’s over a trust, an estate, or a guardianship matter – people are often tempted to record their interactions with the other party. They often believe that the audio or video clip will be helpful in their case. However, before you press that “record' button, you'll want to listen to this Life Happens Radio podcast.
Our litigation team often speaks to clients who have filmed interactions, or audio-recorded phone calls, in an effort to prove that the “other side” is guilty. For instance, a sister records a conversation she shared with her brother because she believes he unlawfully changed their parent’s last will & testament. Or, perhaps a video is recorded of an elderly parent to later show the court that he/she lacked capacity or was being abused.
But as you'll hear from Pierro, Connor & Strauss litigation attorneys Aaron Connor and Jacob Verchereau, there are risks to consider when choosing to record. While you may think you are building a case, that is not always the case. Aaron and Jacob will explain how audio and video evidence can sometimes have an opposite effect. Recordings can also create additional litigation, create questions of fact, and even lead to cases going to trial when it otherwise could have been avoided.
